Updated Information Regarding Salaries in Romania
Salary represents the consideration for the work performed by the employee based on the individual employment contract and is established through individual negotiations between the employer and the employee.
Salary income is confidential and includes:
- Base salary;
- Allowances;
- Bonuses;
- Other additions.
Employer's Obligations
- The employer is obliged to guarantee in payment a gross monthly salary at least equal to the gross minimum basic salary in the country, relative to the work norm negotiated through the individual employment contract or additional documents.
- For employees to whom the employer provides food, accommodation, or other facilities, the amount of money due for the work performed cannot be less than the gross minimum wage stipulated by law.
Gross Minimum Wage in Romania
According to Government Decision no. 598/2024, starting with July 1, 2024, the guaranteed gross minimum basic salary in the country is 3,700 lei/month, for a normal working schedule averaging 168 hours/month, representing 22.024 lei/hour.
Through GEO 156/2024, starting January 1, 2025, the guaranteed gross minimum basic salary in the country was set at 4582 lei for the construction sector, and 4050 lei for the agricultural sector and the food industry (art.LXIX and art.LXX)
- Construction sector: 4,582 lei/month for a normal working schedule averaging 165.333 hours/month, representing 27.714 lei/hour. This level applies exclusively to persons stipulated in art. 60 pct. 5 of the Fiscal Code.
- Starting with January 1, 2025, according to Government Decision no. 1506/2024, the guaranteed gross minimum basic salary in the country for the agricultural and food industry sector is set at 4,050 lei per month. This amount corresponds to a normal working schedule of 165.333 hours per month (on average), which equates to 24.50 lei per hour. This level represents the minimum guaranteed gross salary applicable in these fields, in accordance with the legislation in force.
According to art. 164 para. (8) of the Labor Code (Law no. 53/2003, with subsequent amendments and additions), the gross minimum basic salary in the country can be granted to an employee for a period of no more than 24 months from the date of hiring under the same individual employment contract. After 24 months of seniority in the same contract, the employer is obliged to establish for that employee a higher basic salary than the guaranteed gross minimum wage in the country. Thus, an employee who has accumulated two years of continuous experience with the same employer cannot legally remain at the level of the minimum wage, but must benefit from a basic salary higher than this level, in accordance with current legal provisions.
The minimum salary level established by these decisions does not include allowances, bonuses, and other additions.
Obligations Regarding the Transmission of Salary Changes
Employers are obliged to transmit any change in the gross monthly basic salary, bonuses, or additions in the General Register of Employees (Revisal) within 20 working days from the date of the change. Failure to comply with this deadline constitutes a contravention and is punishable by a fine from 5,000 to 8,000 lei.
