The Attributes of the Labour Inspection in the Field of Control

The Labour Inspection fulfills the function of a state authority, ensuring the exercise of control in the following areas:

• Labour relations;
• Safety and health at work;
• Market surveillance.

The purpose of the control activity is to ensure compliance with and prevent violation of the legal provisions regarding:

• Labour relations;
• Safety and health at work;
• The protection of employees working in special conditions;
• Market surveillance.

Types of Controls in the Field of Labour Relations

• Background checks: Verifies how employers apply the provisions of labour legislation and performs an overall analysis of the activity, in order to eliminate the identified deficiencies and raise the employer's awareness regarding compliance with labour legislation.
• Thematic controls: Covers a limited number of areas regulated by labour legislation and takes place over a short period of time, providing a partial but conclusive picture of the control topic.
• Campaign-type controls: Consists of unannounced checks on one aspect or a limited number of aspects, carried out on fields of activity at a national level or in geographical areas.

Finalization of Control Activity in the Field of Labour Relations

• Control reports: Records findings regarding non-compliance with legal provisions and orders mandatory measures with specific deadlines for completion. The employer has the obligation to fulfill the ordered measures and to inform, in writing, the territorial labour inspectorate regarding their fulfillment.
• Reports of finding and sanctioning contraventions: Applies sanctions for violating the provisions of labour legislation that are considered contraventions.

The implementation of the measures established through the control reports is verified through subsequent controls carried out by the labour inspectors. As a result of the findings from the control activity, the Labour Inspection can notify the criminal investigation bodies when there are indications regarding the commission of offenses.
