Terms and Conditions of Use of the Application

The purpose of this section, entitled "Terms and conditions of use of the application", is to fully and correctly inform those who use the "Inspectia Muncii" application related to the electronic register of day laborers, respectively the Beneficiaries of the activities carried out by day laborers, as defined according to the provisions of Law no. 52/2011 regarding the exercise of occasional activities carried out by day laborers, with subsequent amendments and additions.

Compliance with the law

According to the provisions of Law no. 52/2011 with the amendments and additions made by Government Emergency Ordinance no. 26 of April 18, 2019, regarding the amendment and completion of some normative acts, starting with 20.12.2019 the electronic register of day laborers is established, which will be made available by the Labor Inspectorate to the Beneficiaries of the activities carried out by day laborers, through the application "Inspectia Muncii."

Acceptance of terms and conditions

By downloading the "Inspectia Muncii" application, the Beneficiary/User accepts and agrees to be bound by these Terms and Conditions. We reserve the right to make changes at any time to the Terms and Conditions of use, as well as to the way the application works, and by continuing to use the application, after making these changes, the Beneficiary/User agrees to be bound by those changes.

Privacy policy

Any personal information or materials transmitted through this application are subject to the provisions of the privacy and personal data protection policy, as regulated by Regulation no. 679/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

Application description

The "Inspectia Muncii" application for mobile phones consists of software that can be accessed both in iOS and Android systems, which offers you, as a Beneficiary/User, the possibility to electronically transmit the register of day laborers.

Transmission of the electronic register of day laborers

Any report transmitted through the application may and will be subject to checks by labor inspectors from the territorial labor inspectorates/Labor Inspectorate. The Beneficiary, as a user of the application, takes into account that he is solely responsible for the accuracy and veracity of the information transmitted. The data is stored locally, on mobile phones, only for a limited period of 31 days. We inform you that ITM/IM does not assume responsibility for recovering historical information related to the Beneficiary/User.

Modifications

The Beneficiary/User has been informed and accepts that the Labor Inspectorate reserves the right to modify at any time, unilaterally, the Terms and conditions of use of the "Inspectia Muncii" application. Continued use of the application represents acceptance of all changes made. The Labor Inspectorate will inform the Beneficiaries/Users about the changes made to the application by making available the updated information on the website www.inspectiamuncii.ro, which the Beneficiaries/Users undertake to consult periodically during the use of the application.

Intellectual property rights

The Labor Inspectorate has the right of ownership over the application, its component elements, graphic elements, as well as the content of the application, and the Beneficiary/User understands that he has no right over them, except for the limited right to install and use the "Inspectia Muncii" application, according to the Terms and conditions in this section.

Responsibility

The Beneficiary/User undertakes to keep confidential the login details, passwords and access data (under the collective name "access data") of his account and to inform the Labor Inspectorate immediately, as soon as he becomes aware or suspects that his access data are known to unauthorized third parties. If a third party uses a user account without authorization as a result of obtaining the Beneficiary/User's access data due to his fault, then the user is treated as if he had acted personally.

Warnings

The Labor Inspectorate will not have any legal or other responsibility for any loss suffered due to computer viruses that may affect the device on which you have installed the application. By continuing to install this application, you express your agreement with the conditions stated in this document.
